Terms and Conditions of the BRAINOCTOPUS.COM Service

 

I. General Provisions

1. These terms and conditions set out the rules for using the BRAINOCTOPUS.COM platform, operated by the company BRAINOCTO GmbH, headquartered in Switzerland, which provides users with access to copyrighted osteopathic training videos.

2. By registering and using the platform, the user fully accepts these terms and conditions.

3. The BRAINOCTOPUS.COM platform allows the purchase of access to digital training content, which is available for a specified period.
 

II. Definitions

1. Platform – the BRAINOCTOPUS.COM internet platform that allows the purchase of access to digital training content in the field of osteopathy.

2. User – any natural or legal person using the services of the Platform.

3. Digital Content – training videos on osteopathic topics available on the Platform.

4. Access – the right to use the purchased digital content for a specified period of 30 days from the time of purchase.
 

III. Purchase of Access to Digital Content

1. The user acquires access to the selected digital content by making a payment through the Platform.

2. Access to digital content is granted for a period of 30 days from the date of purchase. After this period, access automatically expires.

3. By making the payment, the user agrees to the immediate provision of the purchased digital content before the expiration of the 14-day withdrawal period. According to Article 38(1)(13) of the Act of May 30, 2014, on Consumer Rights, the user loses the right to withdraw from the contract and return the purchased digital content.
 

IV. Copyright

1. All content available on the BRAINOCTOPUS.COM platform is protected by copyright. All rights to this content belong to the company BRAINOCTO GmbH or the authors who have granted the company BRAINOCTO GmbH a license for distribution.

2. The user does not have the right to copy, share, distribute, or use the content in any manner other than as provided in these terms and conditions.

3. Any infringement of copyright may result in civil and criminal liability.
 

V. Privacy Policy

1. The user agrees to the processing of their personal data for the purpose of fulfilling the order when making a purchase.

2. The user's personal data is processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (GDPR) and the Personal Data Protection Act of May 10, 2018.

3. The user's personal data may be processed for the purpose of fulfilling the order, processing payments, and for marketing purposes, in accordance with applicable legal regulations.
 

VI. Final Provisions

1. The company BRAINOCTO GmbH reserves the right to change these terms and conditions at any time. These changes take effect upon publication on the Platform's website.

2. In matters not regulated by these terms and conditions, Swiss law and the relevant provisions of EU law shall apply.

3. Any disputes arising from the use of the Platform will be resolved by the competent courts in Switzerland.
 

Declarations for the Order

1. Please provide the purchased digital content/service (not delivered on a physical medium) before the expiration of the 14-day withdrawal period. I agree to waive the right to withdraw from the contract and return the digital content or digital service in accordance with Article 38(1)(13) of the Act of May 30, 2014, on Consumer Rights.

2. I declare that I consent to the processing and use of my personal data for the purpose of fulfilling the order, in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, and the Personal Data Protection Act of May 10, 2018 (Journal of Laws 2018, item 1000).
